This agreement sets forth the terms and conditions for and governs the submission of donations to the United States Conference of Catholic Bishops (“USCCB”). This Agreement (the “Agreement”) is between the requesting party (“Requesting Party”) and USCCB, having its headquarters at 3211 Fourth St. NE, Washington, DC 20017. Requesting Party has read and understands this Agreement, and Requesting Party’s agreement to these terms and conditions is required to submit a donation to USCCB via #iGiveCatholic. This Agreement contains the final and entire agreement between Requesting Party and USCCB regarding offers to donate to USCCB via #iGiveCatholic and supersedes all previous and contemporaneous verbal or written negotiations, understandings, or agreements between them. No third party is a beneficiary of the Agreement but 5.25% plus $0.49 of Requesting Party’s donation will be provided to #iGiveCatholic and to platform and credit card hosts as a processing fee; similarly, 3.26% plus $3.00 will be collected on donations paid by ACH bank transfer. The requesting party understands that by submitting an electronic offer to donate, she or he is not making a donation to the USCCB, but rather transmitting a request to USCCB’s contractor, to be acted upon by the contractor in the District of Columbia. The sole jurisdiction and venue for any litigation arising out of this agreement will be an appropriate federal or local court located in the District of Columbia. In the event that any portion of the Agreement is held unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties, and the remainder of the provisions shall remain in full force and effect.
